Terms of Service

The terms for restaurants using MyDelivery in the United States, including the 32-day free trial and $39 monthly subscription.

Last updated: October 28, 2026

1. Who provides MyDelivery

MyDelivery is operated by 51.965.304 GABRIEL PEREIRA DE SOUZA, a business registered in Brazil under CNPJ 51.965.304/0001-24 ("MyDelivery," "we," or "us"). These terms apply to restaurants using the United States version of the platform. Contact us at gabriel.psouza@mydeliveryfood.com.br.

2. The service

MyDelivery provides a restaurant dashboard, an online menu, order management tools, and features for counter, table, kitchen, delivery, and customer support workflows. Available integrations and payment methods are identified in the dashboard. A feature described in marketing material is available only when it is enabled for your account and compatible with your setup.

The restaurant remains the seller of its food and services. It sets its menu, prices, hours, delivery area, taxes, and order policies, and is responsible for preparing and fulfilling customer orders.

3. Accounts and access

You must provide accurate registration information, keep your login secure, and promptly tell us if you suspect unauthorized access. You are responsible for the actions of staff members you authorize. Do not use the platform to break the law, infringe others’ rights, or interfere with the service.

4. Free trial and pricing

New eligible restaurants receive 32 days free. A credit card is not required to start the trial. After the trial, the United States subscription is US$39 per month, charged in U.S. dollars. We do not start a paid subscription unless you choose to subscribe and complete checkout. If you do not subscribe, paid access may be limited when the trial ends.

Any applicable sales tax or payment processing charges are shown before you confirm a payment. We may change future pricing with advance notice; a change does not alter a period you have already paid for.

5. Billing and cancellation

Subscriptions are processed by Stripe. Stripe collects payment details through its secure checkout; MyDelivery receives subscription identifiers and status rather than your full card number. A subscription renews monthly until canceled. You can manage or cancel it from the billing page in your dashboard or by contacting gabriel.psouza@mydeliveryfood.com.br.

Cancellation stops future renewals. Unless required otherwise by applicable law, access continues through the current paid period and charges already paid are not prorated. If a charge fails, we may ask you to update your payment method and limit paid access after reasonable notice. Refund requests are reviewed under applicable law and the circumstances of the charge.

6. Orders, customers, and taxes

The restaurant is responsible for menu accuracy, food safety, fulfillment, refunds to its customers, applicable sales taxes, and any required permits. MyDelivery provides software tools and does not act as the merchant of record for restaurant orders unless a separate written agreement states otherwise. Tax features in the platform are tools; they do not replace professional tax advice, determine all tax obligations, or file tax returns on your behalf.

7. Customer information

You may use customer information obtained through MyDelivery only to fulfill orders, provide service, and carry out lawful restaurant operations. You must protect that information and honor applicable privacy and marketing rules. Our handling of information is explained in the Privacy Policy.

8. Third-party services

Some features depend on providers such as Stripe, messaging services, mapping services, or delivery marketplaces. Each provider may require its own account, approval, terms, and fees. Connecting a provider does not guarantee that its service is available in every location or that its approval will be granted. We will not claim an integration is active for your restaurant until the connection is actually enabled.

9. Availability and support

We work to keep the service available and to address reported problems promptly. Maintenance, internet outages, and failures of third-party services can interrupt access. Contact gabriel.psouza@mydeliveryfood.com.br if you need help. We do not guarantee uninterrupted operation or a specific result from marketing or automated tools.

10. Changes and termination

We may update the platform and these terms. Material changes will be communicated through the service or by email before they take effect when practicable. You may stop using the service and cancel your subscription if you do not accept a change. We may suspend access when necessary to prevent misuse, protect security, or comply with law, and will notify you when reasonably possible.

11. Applicable law and disputes

These terms do not limit rights that cannot be waived under applicable law. We encourage you to contact us first so we can resolve a concern. Any dispute will be handled under the law and jurisdiction applicable to the specific transaction and parties; these terms do not require a U.S. restaurant to waive mandatory local protections.
